| DESCRIPTION | |
| Project description: The overall objective of the project is to contribute to strengthening of the rule of law in the Russian Federation through promoting a comprehensive use of Russian Federation Criminal Procedure Code provisions regarding advocate's pre-trial investigation. The specific objectives / purposes of this contract are: 1. To strengthen the institution of advocate's investigation within Russian criminal procedure. 2. To develop additional training mechanisms within the advocates' community. 3. To strengthen the system of free legal aid provided by advocates. Job description: In order to achieve the contract objective the Consultants shall perform the following tasks: 1. To conduct an assessment of current regulatory framework for carrying out parallel advocate's investigation at the pre-trial stage and existing implementation practices. The analysis should cover issues of legal framework, sources of funding, organisation of service delivery, performance standards and quality, ability to strategically plan and set priorities for the use of resources available, the scope and nature of services provided by advocates in these fields, etc. The analysis should also look into the possibilities of expanding the rights of the defence counsel regarding parallel investigation and the possibilities for introduction of new procedures. The results of the study should be presented in the form of separate report. 2. To make research of current practices in this field in the EU countries. The Consultant shall compile EU best practices in the field of defence rights to conduct its own investigation and present evidence in criminal proceedings including relevant legislative provisions. Special emphasis shall be put on the means of granting equality of arms in criminal investigation including those kinds of defence activities aimed at collecting evidence which are covered by legal aid schemes. The results of the research should be presented in the form of compendium of best European practices. 3. To develop recommendations based on the assessment of current situation in Russia and best European practices. On the basis of the assessment, compilation of EU best practices and consultations with the stakeholders, the Consultant shall devise the design of particular policy proposals. The support would include elaboration of main policy alternatives, institutional and procedural design (including modalities of organisational framework, procedures, setting priorities and sources and criteria for funding). Moreover, links with the overall judicial reform in Russia, alignment with the ECHR jurisprudence and internalisation of international standards and principles should be adequately recognised and integrated. Policy advice shall include recommendations on preparing concrete legal drafts and drafts of relevant normative acts. 4. To develop training methodology to be used in the system of vocational training of advocates. On the basis of the assessment, compilation of EU best practices and consultations with the stakeholders, the Consultant shall develop training methodology and prepare the training curricula and materials aimed at the development of investigative skills and strategic approach to advocate's investigation among practicing advocates. The training curricula or training programme in this sphere of professional growth potential are to be composed of different modules (such as development of specials skills in collection of evidence, development of investigative strategies and techniques etc.). Outlines and training/pedagogica 5. To present the results of analytical work performed. After completion of analytical work under the project the Consultant shall hold public consultations in the form of seminar/workshop which should involve all main stakeholders. Through that activity, the project would need to ensure that the actual policy proposals, legal drafts and training methodology are reflecting needs, concerns and challenges being faced by those stakeholders. The required outputs of the Consultants are as follows: - An assessment of current regulatory framework for carrying out parallel advocate's investigation at the pre-trial stage and existing implementation practices in Russia; - A research of current practices in this field in the EU countries; - Capacity development and transfer of EU know-how on conducting advocates investigation in criminal cases at the pre-trial stage; - Draft legislation on expanding the defence rights for collecting evidence and design of modalities for granting this right especially in case of providing free legal aid to indigent citizens; - Recommendations (policy proposals) based on the assessment of current situation in Russia and best European practices; - Training methodology to be used in the system of vocational training of advocates; - Presentation of the project work to the dialogue or working group, conducting public consultations. TEAM LEADER (SENIOR) Compulsory minimum requirements: Qualifications and skills: Higher legal education, having a PhD in law is an additional advantage; Perfect knowledge of English is a must; General professional experience: Not less than ten years of experience in the field of legal drafting and legal reform; Experience in conducting analytical research studies including comparative studies, possibly with an academic background; Practical experience in establishing cooperation with judicial, governmental and public organizations; Specific professional experience: Not less than five years of experience in legal and advocacy reform in transition countries; Strong project cycle management experience in EC funded projects, preferably also in Russian Federation; Adequate knowledge of the judicial, administrative, legal and political structure of the Russian Federation. EXPERT II (SENIOR) Compulsory minimum requirements: Qualifications and skills Higher legal education Perfect knowledge of English and Russian Training in the field of human rights and ECHR jurisprudence is an additional advantage General professional experience Not less than ten years of experience in the field of legal drafting including for relevant public institutions (such as parliaments, relevant ministries); Experience in conducting analytical research studies including comparative studies; Practical experience in establishing cooperation with judicial, governmental and public organizations, including relevant BAR associations Specific professional experience Not less than five years of experience in drafting criminal procedure legislation or legislation on advocacy; Not less than five years of experience in the projects of development partners (EU, World Bank, other major multilateral or national donor organisations) In-depth knowledge of the judicial, administrative, legal and political structure of the Russian Federation. EXPERT III (JUNIOR) Compulsory minimum requirements: Qualifications and skills Higher legal education; Perfect knowledge of English and Russian; Training in the field of finance management General professional experience Not less than three years of experience in the field of legal training (preparation of training materials, development of training curricula, conducting seminars); Relevant experience in conducting analytical research studies including comparative studies in the Russian Federation; Practical experience in establishing cooperation with judicial, governmental and public organizations in the Russian Federation Specific professional experience Not less than three years of experience in teaching criminal procedure rules or advocacy skills; Not less than three years of experience in the projects of development partners (EU, World Bank, other major multilateral or national donor organisations) In-depth knowledge of the judicial, administrative, legal and political structure of the Russian Federation.
