Description

 

 

ANNEX II: TERMS OF REFERENCE

 

1.            BACKGROUND INFORMATION

 

The Financing Agreement for the Trade Related Assistance Project was signed on 18 October 2007, under the 9th EDF programme for a total amount of 3,3 mi €. The Trade Related Assistance Project will seek to support the governments export led growth strategy through three main components:

 

1.         Trade policy formulation and implementation in PNG;

 

2.         Enhancement of quality infrastructure to increase competitiveness; in particular in the field of technical barriers to trade (TBT) and sanitary and phytosanitary  systems (SPS), also in the field of fisheries (institutional support level/meso-level)

 

3.         Support selected export promoted activities.

The project will also enable PNG to better benefit from international trade agreements, including the Economic Partnership Agreements (EPA).

The contract awarded after tendering for the recruitment of the long term technical assistant had to be cancelled. The tender will be re – launched. This 6 month recruitment will enable to bridge the tendering period and to implement the start – up activities.

The expert of this assignment will be allowed to participate in the tendering process for the long term assignment.

 

2.            DESCRIPTION OF THE ASSIGNMENT

 

Global Objective

The Global Objective of this contract is to support PNG in benefiting more from international trade with a view to increased growth and through that to contribute to poverty reduction in the country.

Specific Objective

The specific objective of this contract is to support PNG in improved mainstreaming of trade matters in development and sector strategies, more effective participation in regional and multinational trade agreements and increased international trade business.

Requested Services, including suggested methodology

The advisor is to support the Trade Division during the Start up Programme Estimate period and achieve the objectives of the Start up Programme Estimate, which includes:

 

           Preparation of the National workshop

 

           Initiating and Delivering a database for the contracting of local consultants

 

           Initiating and delivering a database containing all relevant stakeholders, private, public, organisations, and companies. There should be in place a structured system containing a reasonable range of access keys to broadly available information services to exporters, to possibilities for marketing initiatives, feasibility studies etc.

 

           In consultation with the Trade Division draft a National Executive Council (NEC) Policy Paper seeking mandate of trade function and composition of the Trade Advisory Board

 

           Preparing for the projects' first operational programme estimate, inclusive of:

                        Fine tuning the logical framework

                                   Preparing the detailed work programmes, the Operational Programme Estimate No.1

                                   Drawing the provisional implementation work plan

                                   Preparing the detailed budget and financing plan

                                   Drawing up the technical and administrative implementing arrangements

Required Outputs

 

Project Component 1: Strengthening the Capacity of DoFATI in trade policy formulation and implementation, trade policy analysis and trade negotiations

 

         Provide advice and technical assistance to the DoFTI on all aspects of trade policy, in particular establishing clear priorities and appropriate action plans

 

         Support DOFTI in acting as Secretariat to DOFTI (possibly directed toward a newly established Trade Policy Advisory Board) responsible for mainstreaming trade policy  and co-ordination of institutional and sectoral activities in trade related areas

 

         Assist DOFTI in the setting up of (temporary) ad-hoc technical working groups to deal with specific issues, sectors; under the responsibility of DOFTI (or the Trade Policy Advisory Board) 

 

         Preparation and distribution of explanatory documents including the production of an information booklet on trade policy measures and practices.

 

         Establish a data base on updated trade information

 

         Establish information data base on market requirements, regulations etc, and dissemination mechanism.

 

         Support in drafting/review/revision of relevant regulation on trade policy related matters (e.g. SPS, TBT, antidumping, countervailing measures, safeguards, TRIPs, etc.)

 

         Other Institution Building activities in trade related matters 

 

Project Component 2: Institutional (technical) support services for international trade

 

a) Capacity building for National Institute of Standards and Industrial Technology (NISIT),National Agriculture Quarantine Inspection Authority (NAQIA) and National Fisheries Authority (NFA)

 

         Analyse present capacity of NISIT,NAQIA and NFA to provide services required for supporting international trade

 

         Establish clear priorities and appropriate action plans

 

         Assess training needs at NISIT, NAQIA and NFA

 

         Assess availability of equipment at NISIT, NAQIA and NFA and need for procurement of additional key equipment, aiming at creating more trade opportunities

 

         Establish an information data base for Standardisation and SPS and set up a system for dissemination

b) Capacity building for Customs services (within the Internal Revenue Commission - IRC)

 

         Analyse current Customs Procedures/ Customs Valuation, establish clear priorities and appropriate action plans, recommend actions for improvement

 

         Assess training needs for improving customs operations and facilitation

 

Project Component 3

 

a) Capacity building for business oriented institutional support services, e.g. for the Investment Promotion Authority (or new Trade Promotion Organisation if such an option is implemented at a later stage), Small Business Development Corporation (SBDC), domestic public and private consulting institutions/firms which may come up, etc

 

         Assist in organising and integrating export development and promotion services into range of services offered

 

         Establish clear priorities and appropriate action plans

b) Trade development and promotion at sector/company level (pilot activities)

In view that so far there is not yet a systematic assistance system for trade development and promotion at sector/company level in PNG it is proposed to start within this project to test and prepare the groundwork for such services at a pilot basis for priority areas to be identified:

 

         Support institutions in identifying and pre-selecting of sectors with export potential in existing and new products and services, similarly for import substitution and down streaming investments

 

         Support in assessing export potential of sectors/companies in priority areas regarding

o          Export management capabilities

o          Supply side potential

o          Market potential

o          Access to and handling of information

 

         Help define needs for assistance in priority areas at sector/group level (and at maybe individual company level)

 

         Support the establishment of help desk and cooperate with international help desks (e.g. EC, ITC, country help desks)

 

         Help carrying out advisory and training services for import substitution and downstream investments

 

         Preparation and dissemination of training materials, export guidelines, directories

 

         Help establish trade information system at DoFATI  for use also to companies

 

3.            EXPERTS PROFILE

 

Only one expert will be recruited through this contract and for 6 month duration. The Technical Assistant will be the key interlocutor of the Supervising Authority concerning capacity building and support. Capacity building being the main objective of this assignment, his role should rapidly evolve from coordinator to advisor of the programme. He will be the team leader during programme implementation. As team leader he will be responsible for the efficient and effective implementation of the external support towards full embracement of its mandate by the Supervising Authority.

           

Profile Required

 

Key expert 1: Category I International Team Leader from EU15, also acting as advisor/coordinator

 

a) Qualifications, skills and professional experience

           University Degree in Law, Economics, or other relevant discipline.

           Appropriate post graduate qualification in International Trade, International Economics, or related discipline.

           15 years of increasingly responsible professional experience in the programming, implementation, monitoring and/or evaluation of trade related projects with at least 5 years experience in EDF procedures, Experience with EDF-9 would be an asset

           Fluent in spoken and written English with excellent report writing skills.

           Experience in capacity building

           Experience with managing trade development and promotion projects which involve also technical aspects of quality and standards infrastructure, (phyto-) sanitary measures etc.

           Experience in the programming and implementation of trade development assistance in Pacific region or in developing countries.

           Highly experienced in the implementation of EC funded Technical Assistance Projects in ACP countries (specific experience in PNG or Pacific area would be considered an asset).

           Considerable experience in the management of international projects including the use of project management software.

           Excellent communication and presentation skills (including the use of presentation software).

           Excellent skills in information and communication technology.

           Good working knowledge of EU trade policies

 

Working Language

 

            The working language must be in English. 

 

4.            LOCATION AND DURATION

 

The intended commencement date is 25th February 2009 and the period of execution of the contract will be 6 months from this date. An estimated maximum of 135 working days (which includes travel days required for this assignment). The Contracting Authority reserves the right to extend the period of execution of the project.

 

Location of Assignment

 

The project will be based in Port Moresby although travel throughout Papua New Guinea will be required. International travel in connection with missions, study tours etc. may be required. Travel an per – diems will be covered under the programme estimate.

5.            REPORTING

 

The Inception Report must be submitted to the Supervising Authority, Department of Foreign Affairs, Trade and Immigration within two months of the start of the project.  The Supervising Authority will verify and comment on the report and forward it to the Contracting Authority which will forward it to the EC-Delegation. The Inception report must contain an analysis of the starting situation of the project, a reassessment of the assumptions upon which the project is based and the risks to the achievement of the project results identified in these Terms of Reference and in the Financing Agreement.

 

One Mid-term Progress Report (about 2 pages) must be submitted to the EC Delegation and Contracting Authority within five working days of the end of the first quarter. The executive summaries of the analysis, comments, recommendations and way forward concluding short term missions will be annexed.

 

One final technical report is to be submitted. This report will synthesise the activities achieved, and propose detailed work programmes for the next period based on the general plan foreseen in the inception report and completed and detailed taking opportunity of the experience gained (lessons learned). The final report will contain the information necessary for the recruitment processes of the following year.

Submission & approval of progress reports

 

Four (4) copies of the reports will be submitted to the Supervising Authority which will verify and comment on the report before forwarding it to the Contracting Authority. The Contracting Authority will transmit one commented copy to the EC-Delegation. The progress reports must be written in English.  The approval of the reports by the Supervising Authority for technical matters and the Contracting Authority for financial and contractual matters is to be annexed to the invoice of the Consultant for the corresponding period.
